1. Purpose and Parties
Forged Mod is an intermediary platform between Creators (hereinafter Sellers) who publish digital mods for Assetto Corsa and Customers who purchase them.
2. Nature of the Products and Technical Requirements
The products are downloadable digital files protected by Forged Mod’s proprietary digital rights management application. The purchase grants the customer a single-user, non-transferable license to use the mod, not ownership thereof.
The mods require an active internet connection to function, as Forged Mod’s DRM system validates user access through its servers. The customer acknowledges and accepts this requirement prior to purchase.
3. Conditions for Creators (Sellers)
- The seller pays an annual fee for each published mod, which renews automatically unless canceled.
- Forged Mod retains a 30% commission on each sale; the remaining 70% corresponds to the Seller, paid via PayPal.
- The seller guarantees that they hold all necessary rights to the content and that it does not infringe upon third-party rights.
- Every mod is subject to prior review and approval. Forged Mod reserves the right to accept or reject sellers and content, as well as to remove already published mods, based on objective criteria such as quality, legality, technical requirements, or suitability for the platform, without the right to compensation.
4. Protection Process
All mods are distributed protected by the Forged Mod application. The customer receives only the protected version.
5. Acceptable Use and Account Suspension
- The customer agrees not to bypass the application protecting the mods or to redistribute the mods.
- Non-compliance may result in account suspension or termination, without a refund, and without prejudice to legal action.
6. Mod Lifecycle
If a seller does not renew the subscription:
- The mod is no longer sold.
- It remains encrypted.
- Buyers retain access.
7. Payments, Withdrawal, and Refunds
- Payments are processed via PayPal.
- Once virtual content is purchased, no returns are allowed.
- As it is digital content, the right of return is excluded once downloading or access has begun, in accordance with Art. 103.m) of RDL 1/2007.
- By purchasing, the customer accepts immediate execution and the loss of their right of withdrawal.
8. Tax Obligations
- Forged Mod will apply VAT in accordance with EU regulations (OSS).
- Sellers are responsible for their own tax obligations.
9. Limitation of Liability
Forged Mod acts as an intermediary and does not guarantee the functionality of the mods, without prejudice to prior review.
10. Governing Law and Jurisdiction
- This agreement is governed by Spanish law.
- The parties submit to the competent courts in accordance with the law.
